Terms of Service

These Terms govern the Spark iOS app, MyFounders AI website, accounts, user content, AI features, creator tools, communications, moderation, and payment features.
Acceptance and scope
These Terms of Service are an agreement between you and Federated Unified Worker Network Inc for your use of Spark, the MyFounders AI iOS app, website, and related services. By creating an account, accessing Spark, or using a feature, you agree to these Terms and the Privacy Policy.
If you do not agree, do not use Spark. Additional terms shown in a payment, creator, promotion, or App Store flow also apply to that feature.
Eligibility, accounts, and security
You must be legally able to enter this agreement and must provide accurate account information. Spark is not intended for children under 13. If you are under the age of legal majority where you live, a parent or guardian must authorize your use when required by law.
You are responsible for your account, devices, authentication credentials, and activity. Notify us promptly if you suspect unauthorized access. You may not sell, transfer, impersonate, or create deceptive accounts.
Your content and license
You retain ownership of content you create. You represent that you have the rights and permissions needed to upload, publish, license, and share it and that doing so does not violate law or another person's rights.
You grant Federated Unified Worker Network Inc a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt for technical formatting, display, distribute, and make your content available only as reasonably necessary to operate, secure, moderate, promote within, and improve Spark according to your settings. This license ends when the content is deleted except for reasonable backups, legal or safety retention, and copies already shared with others.
You are responsible for reviewing visibility, membership, and sharing settings before publishing. Public content may be indexed, linked, copied, or shared by others.
Safety rules and moderation
You may not use Spark to post, request, facilitate, or distribute illegal, exploitative, sexually abusive, threatening, hateful, harassing, violent, self-harm-promoting, fraudulent, privacy-invasive, infringing, malicious, or otherwise unsafe content; spam or manipulate engagement; evade enforcement; scrape or reverse engineer the service; or interfere with accounts, security, or infrastructure.
Spark may use automated and human review before or after publication. We may reject, quarantine, limit, remove, preserve, or report content; restrict visibility; disable features; suspend or terminate accounts; and cooperate with authorities when appropriate. Automated moderation can make mistakes. You may contact support to request review.
Members can report content and block other members. Creators and moderators must use their tools responsibly and may not retaliate against good-faith safety reports.
Messages, Communities, Challenges, and creators
Spark provides member communications and creator-operated profiles, Projects, Communities, Challenges, AI characters, content schedules, and events. Creators are responsible for their descriptions, promises, schedules, member management, content rights, and compliance with law. Unless expressly stated, creators are independent users and do not act for Spark.
Some conversations use end-to-end encryption. Encryption does not make unlawful content permitted, guarantee recipient behavior, or prevent recipients from saving, forwarding, or reporting messages. Do not rely on Spark for emergency communications.
Participation, results, availability, creator activity, audience growth, community value, challenge outcomes, or AI-character performance are not guaranteed.
AI features and saved memory
AI features may generate, classify, summarize, moderate, rewrite, or suggest profiles, Projects, applications, messages, or other material. AI output can be incomplete, inaccurate, biased, offensive, outdated, or unsuitable.
You are responsible for reviewing AI output before saving, publishing, sending, or relying on it. Do not use AI output as a substitute for qualified financial, investment, legal, tax, employment, real-estate, medical, or other professional advice. No professional, fiduciary, employment, partnership, or client relationship is created by using Spark.
Payments, subscriptions, and creator support
When a payment feature is offered, the price, currency, billing period, provider, and material transaction terms are presented in the applicable flow. Payments may be processed by Apple, Stripe, or another provider identified at checkout and are also subject to that provider's terms and refund rules.
Spark account plans may provide higher limits for Communities, Projects, AI characters, Challenges, storage, and analytics history. The plan screen identifies the current included limits. Creator and Pro plans renew automatically until canceled. A cancellation normally remains effective through the paid billing period. If a paid plan ends, existing content may remain available, but creating or uploading beyond the Free-plan limits may be restricted until usage is reduced or a paid plan is restored.
Paid Community subscriptions renew until canceled unless the transaction flow says otherwise. Access may end when a subscription expires, is canceled, refunded, reversed, or remains unpaid. Canceling normally prevents future renewal and does not by itself create a refund for a completed billing period, except where required by law or the payment provider's rules.
A creator may offer a Community promotion code for the percentage and duration displayed at checkout, including a limited free period. Unless checkout expressly says otherwise, the paid Community subscription continues at the regular recurring price after the promotion ends until canceled. Codes have no cash value, may be subject to eligibility or one-redemption limits, and may be deactivated for future use. Deactivation does not shorten a promotion already applied to an active subscription unless the checkout terms, provider rules, or law require otherwise.
Optional creator-support payments are tips and do not purchase equity, investment rights, professional services, account approval, paid content, or guaranteed access. Spark currently retains no platform fee from creator-support payments. Apple, Stripe, and payout providers may still deduct their processing, store, tax, refund, currency-conversion, or payout charges before funds reach a creator.
Spark currently retains a 10% platform fee from paid Community transactions. Apple, Stripe, and payout providers may separately deduct their applicable charges. The checkout flow controls when a creator price, currency, billing period, and final member price become effective.
By publishing a paid Community, the creator agrees to provide the described access and content, keep payout and tax information current, authorize Spark to retain the disclosed platform fee, and cooperate with reasonable refund, dispute, fraud-prevention, and legal-compliance requests.
Payment features may be unavailable in some app versions, storefronts, regions, or accounts. Creators are responsible for taxes, payout eligibility, accurate offering information, and obligations associated with their earnings.
Copyright and other rights complaints
If you believe content on Spark infringes copyright, trademark, publicity, or another right, email hello@myfounders.ai with your contact information; identification of the protected work or right; the exact URL or location of the material; a good-faith statement that the use is not authorized; and a statement, under penalty of perjury, that your report is accurate and that you are the rights holder or authorized to act for them. Include your physical or electronic signature for a copyright complaint.
We may remove or restrict material while reviewing a complaint and may terminate repeat infringers when appropriate. If your content was restricted or removed by mistake, reply to the notice or contact support with the material's location, your explanation and supporting rights information, and a request for review.
Spark intellectual property and third-party services
Spark's software, design, trademarks, brand elements, documentation, and service content are owned by Federated Unified Worker Network Inc or its licensors. These Terms do not grant you ownership. You may not copy, sell, sublicense, scrape, reverse engineer, or misuse them except as law expressly permits.
Spark may contain links to or integrate Apple, Stripe, creator websites, social platforms, AI providers, and other third-party services. We do not control and are not responsible for their content, availability, security, terms, or privacy practices.
Account suspension and termination
You may stop using Spark and may delete your account through website Account Settings or the app. Deletion and retention are described in the Privacy Policy.
We may limit, suspend, or terminate accounts, content, payments, or access when reasonably necessary for security, safety, legal compliance, payment risk, repeated inactivity, violation of these Terms, or protection of Spark and its users. Where appropriate, we may provide notice or an opportunity to appeal, but immediate action may be necessary.
Disclaimers and limitation of liability
To the maximum extent permitted by law, Spark is provided as is and as available without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy, security, or error-free performance.
To the maximum extent permitted by law, Federated Unified Worker Network Inc and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost opportunities, creator conduct, or user content arising from Spark. Nothing in these Terms excludes liability that cannot legally be excluded.
Governing law, changes, and contact
These Terms are governed by the laws of California, USA, without regard to conflict-of-law principles, unless the law where you live requires otherwise. Courts with lawful jurisdiction may hear disputes that cannot be resolved informally.
We may update these Terms as Spark, payment options, safety requirements, or law changes. The effective date above identifies the current version. If a material change requires notice or consent, we will provide it through a reasonable channel.
